1. Acceptance of terms
By downloading, installing, or using VO2 Plan ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. The App is operated by LWMH Global LLC ("we," "us," "our").
2. Description of service
VO2 Plan is an iOS application that reads your VO2 max data from Apple HealthKit, provides fitness classification information, and generates structured training schedules with guided workout timers. The App includes an Apple Watch companion for heart rate monitoring during workouts.
The App offers both free and premium subscription tiers. Premium features include full VO2 max history, training plans, guided workouts, widgets, and notifications.
3. Not medical advice
VO2 Plan is not a medical device and does not provide medical advice. The App provides general fitness information and structured training schedules based on published exercise science research. It does not diagnose, treat, cure, or prevent any disease or medical condition.
The training schedules, heart rate targets, and fitness classifications provided by the App are for informational and educational purposes only. They are not personalized medical recommendations.
You should consult a qualified healthcare provider before beginning any exercise program, especially if you have cardiovascular disease, high blood pressure, diabetes, respiratory conditions, musculoskeletal injuries, or any other health concerns. If you experience dizziness, chest pain, shortness of breath, or any unusual symptoms during exercise, stop immediately and seek medical attention.
No specific health outcomes are guaranteed. Individual results vary based on genetics, baseline fitness, adherence, nutrition, recovery, age, and other factors outside the App's control.
4. Assumption of risk
Exercise carries inherent risks, including the risk of physical injury, cardiovascular events, and in rare cases, death. By using VO2 Plan, you acknowledge that you understand these risks and voluntarily assume them.
You are solely responsible for determining whether a particular workout or training intensity is appropriate for your current fitness level and health status. The App's training schedules are generated based on general fitness categories, not individualized medical assessment.
You are responsible for exercising within your capabilities and for stopping any workout if you feel unwell.
5. Subscriptions and payments
VO2 Plan offers premium features through auto-renewable subscriptions and a one-time lifetime purchase, all processed through Apple's App Store.
Pricing
VO2 Plan offers monthly, annual, and lifetime subscription options. Current pricing is displayed in the App and on the App Store product page. Prices may vary by region and are subject to change.
Billing
All payments are processed by Apple through the App Store. We do not collect or store your payment information. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID account settings.
Refunds
Refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly.
6. Limitation of liability
To the maximum extent permitted by applicable law, LWMH Global LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to personal injury, property damage, loss of data, or loss of revenue.
Our total aggregate liability to you for any claims arising from or related to your use of the App shall not exceed the amount you paid to us for the App in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
7. Indemnification
You agree to indemnify, defend, and hold harmless LWMH Global LLC, its officers, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
8. HealthKit data
The App accesses Apple HealthKit to read VO2 max history, heart rate data, and workout records, and to write workout records. All HealthKit data remains on your device. We do not transmit, store, sell, or share your HealthKit data. For full details, see our Privacy Policy.
9. Intellectual property
The App, including its design, code, content, training algorithms, and trademarks, is owned by LWMH Global LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the App without our written permission.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately. Sections 3, 4, 6, 7, and 11 survive termination.
11. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in New York.
12. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
